


The High Court has issued a landmark ruling prohibiting the unethical practice of determining and disclosing the sex of an unborn child.
In a judgment aimed at protecting women’s rights and ensuring social balance, the court ordered that the sex of a fetus—whether boy or girl—must no longer be revealed under any circumstances.
The full text of the verdict, delivered by the High Court bench comprising Justice Naima Haider and Justice Qazi Zeenat Haque, was published on Monday (May 11, 2026). A short order in the same case was earlier announced on February 25, 2024.
In its observations, the court said that fetal sex determination and disclosure contribute to discrimination against women, increase the risk of female infanticide, and disrupt social harmony. The practice, it added, violates constitutional guarantees of equality, dignity, and the right to life.
The court further noted that such practices are inconsistent with international human rights obligations.
It also pointed out long-standing gaps in enforcement mechanisms in Bangladesh. According to the judgment, issuing guidelines alone is not enough. Effective implementation requires monitoring systems, digital oversight, and strong accountability measures to prevent unethical medical practices.
