A judge has ruled that Halle Berry’s 13-year-old son Maceo will be allowed to testify in court amid an ongoing legal battle between the Oscar-winning actress and her ex-husband Olivier Martinez.
The judge specified that Maceo's testimony will be strictly limited to Martinez’s request for a restraining order against Berry. The dispute stems from a September 26 incident at Berry’s home where Martinez alleged that Berry physically abused their son during an argument. Berry has strongly denied all allegations.
Martinez is seeking sole custody of Maceo and a temporary restraining order while Berry’s visitation rights have been temporarily restricted under an earlier court order. Martinez argued that his son should be allowed to speak directly to the court about what occurred.
Berry opposed allowing Maceo to testify with arguing in court filings that Martinez has discussed the case with their son and influenced his recollection of events also describing him as a "coached and manipulated child." She requested that the court rely on statements from other witnesses instead including her fiance musician Van Hunt and her 18-year-old daughter, Nahla.
Berry and Martinez married in 2013 and finalized their divorce in 2023 and having previously shared joint custody. The court proceedings remain ongoing.
